OVERVIEW

Welcome to BeingImages (“we”, “us”, “our”). We operate this website and online store, including all information, tools, products, and services available to you (collectively, the “Services”). BeingImages is powered by Shopify, which enables us to provide these Services.

By accessing, browsing, or purchasing from our website, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy [LINK].

If you do not agree, please discontinue use of our Services.

SECTION 1 — ACCESS AND ACCOUNT

By using the Services, you confirm you are at least the age of majority in your location, or you have provided consent for any minor dependents to use the Services under your supervision.

To purchase from our store, you must provide accurate and complete information (billing, payment, shipping, contact details). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

SECTION 2 — OUR PRODUCTS

We make every effort to display products accurately; however, colors and appearance may vary based on your device and screen settings.

We do not guarantee that any product or artwork will exactly match its online depiction.

We reserve the right to modify, discontinue, or limit product quantities at any time without notice.

SECTION 3 — ORDERS

By placing an order, you make an offer to purchase. We may accept or reject orders at our discretion. Your order is accepted only after payment is processed and confirmed.

Please review your order carefully before submitting, as cancellations may not be possible once production begins.

All purchases are subject to our Refund Policy [LINK].

Products are intended for personal use only, not for commercial resale.

SECTION 4 — PRICES AND BILLING

Prices may change at any time without notice. The price you see at checkout is the price charged.

Unless stated otherwise, prices do not include taxes, duties, import fees, or shipping.

You agree to provide accurate payment information and authorize us to charge your payment method for all purchases, including applicable taxes and shipping costs.

SECTION 5 — SHIPPING AND DELIVERY

Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.

Once an order is handed to the carrier, risk of loss transfers to the customer.

SECTION 6 — INTELLECTUAL PROPERTY

All content on the Services—including artwork, images, designs, trademarks, text, and graphics—is the property of BeingImages, Shopify, or respective licensors.

You may not copy, reproduce, sell, modify, or exploit any part of the Services without our written permission.

SECTION 7 — OPTIONAL TOOLS

You may have access to third-party tools. These are provided “as is” without warranties. Use of optional tools is at your own discretion and risk.

SECTION 8 — THIRD-PARTY LINKS

We may link to third-party websites. We are not responsible for their content, policies, or actions.

Use of third-party sites is at your own risk.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Shopify powers our store, but all sales are made directly between you (the customer) and BeingImages.

Shopify is not responsible for any damages, claims, or issues arising from your purchases.

SECTION 10 — PRIVACY POLICY

Your personal information is processed according to our Privacy Policy [LINK] and Shopify’s privacy practices.

Information you submit may be handled in countries outside your own jurisdiction.

SECTION 11 — FEEDBACK

By submitting feedback, reviews, or suggestions, you grant us a perpetual, worldwide, royalty-free license to use that content for improvements, promotion, or any lawful purpose.

You must have rights to all content you submit and ensure it does not violate third-party rights.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors or inaccuracies. We reserve the right to correct or update such information at any time and cancel orders if needed.

SECTION 17 — INDEMNIFICATION

You agree to indemnify BeingImages, Shopify, and their affiliates against any claims arising from your misuse of the Services or breach of these Terms.

SECTION 18 — SEVERABILITY

If any part of these Terms is found invalid, the rest will remain in full force.

SECTION 19 — WAIVER; ENTIRE AGREEMENT

Failure to enforce any right does not waive that right.

These Terms, together with our posted policies, form the entire agreement between you and BeingImages.

SECTION 20 — ASSIGNMENT

You may not assign your rights under these Terms.

We may assign our rights without notice.

SECTION 21 — GOVERNING LAW

These Terms are governed by the laws of the jurisdiction where BeingImages is headquartered.

SECTION 22 — HEADINGS

Section headings are for convenience and do not affect interpretation.

SECTION 23 — CHANGES TO TERMS

We may update these Terms at any time. Changes become effective when posted. Continued use of the Services means acceptance of updated Terms.

SECTION 24 — CUSTOM ARTWORK TERMS (Added for BeingImages)

 

24.1 Image Submission

You must upload clear, high-quality reference photos.

We are not responsible for artwork limitations resulting from low-quality or unclear images.

24.2 Proof Creation and Revisions

You will receive a digital preview within the stated timeline. You may request revisions as outlined in our Refund & Revision Policy.

24.3 Approval Before Production

We begin production only after you approve the final artwork.

Approval includes clicking “Approve,” sending written confirmation, or communicating approval through your customer portal.

24.4 No Refunds or Returns After Approval

Once approved, custom artwork becomes final sale.

Because your product is made exclusively for you and cannot be resold, no refunds, cancellations, or returns are accepted after approval—except in cases of production damage or error.

24.5 Incorrect or Damaged Items

If your final product arrives damaged or differs materially from the approved proof, contact us within 7 days with photos.

We will replace or refund as appropriate.

24.6 Artwork Usage Rights

By submitting photos, you grant us permission to use them for creating your artwork and for internal quality audits.

We will only use finished artwork in marketing with your explicit permission.

24.7 Revision Abuse

Excessive revisions, drastic style changes, or unreasonable requests may be limited at our discretion.

24.8 Missed Communication

You are responsible for checking your email (including spam/junk).

Delays caused by missed communications are not the responsibility of BeingImages.
